TD Friends of the Environment and Earth Day® Canada “Art” Contest Rules

1. CONTEST PERIOD: The TD Friends of the Environment and Earth Day Canada “Art” Contest (the “Contest”) ends at 4:59:59 p.m. Eastern Time (“ET) on Friday, November 11, 2011 (the “Contest End Date”). This Contest is sponsored by the TD Friends of the Environment Foundation (the “Sponsor”).

2. ELIGIBILITY: This Contest is open to all legal residents of Canada, who are students in Grades one through eight inclusive, at the time of entry into the Contest.

3. HOW TO PARTICIPATE: “Entrant”: A person, who submits a drawing or illustration (“Drawing”), coloured however they like, to the Sponsor.

A. Substantive Content:
The content of the Drawing must:
a) Be an original idea; and,
b) Be visually related to the theme: “My favourite part of nature”
And
The content of the Drawing must NOT contain any words or text; and must NOT infringe the rights of any third party.

B. Procedural Content: In addition, the Drawing must adhere to the following requirements to be approved and entered into the Contest:

  • The Drawing must be on an 8.5” x 11” piece of paper;
  • The Drawing must be 2-dimensional only (flat surface);
  • The Drawing must be ORIGINAL artwork only (Photographs, computer-generated images or photocopies will not be accepted);
  • The Drawing must consist of at least 2 colours (Black and white drawings will not be accepted);
  • The Drawing may be in crayon, paint, coloured pencils, etc. or any combination; and,
  • The Drawing must not contain any content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the Contest judges in their sole discretion.

To enter, mail your Drawing along with a Contest Registration Form containing your name, phone number, grade, teacher’s name, school name and address, AND parent/guardian (“Representative”) signature to:

All entries must be postmarked no later than Friday, October 14. Limit of one (1) entry per person. THE DRAWING MUST HAVE BEEN CREATED SOLEY BY THE ENTRANT SUBMITTING IT.

Drawings will not be returned to the Entrants and will become the joint property of The Sponsor and Earth Day Canada (EDC) upon receipt. Representatives agree, on request, to assign copyright in the Drawing to the Sponsor and EDC jointly and to execute a waiver of moral rights and any other required documentation.

4. PRIZES: There are ten (10) Prizes (the “Prize(s)”) available to be won, namely, one (1) Grand Prize and nine (9) Secondary Prizes, available to be won, as follows:

A. One Grand Prize:

(i) The winning Entrant receives:
(a) One (1) digital video camera with an approximate retail value of Two Hundred and Fifty Canadian Dollars (CDN$250); and,
(b) One (1) Litterless Lunchbox with an approximate retail value of Thirty-Five Canadian Dollars (CDN$35).
And
(ii) The winning Entrant’s classmates receive one (1) Litterless Lunchbox with an approximate retail value of Thirty Five Canadian Dollars (CDN$35).
And
(iii) The winning Entrant’s School receives Seven Thousand Five Hundred Canadian Dollars (CDN$7,500) for the development of an outdoor classroom or schoolyard naturalization project at the School.
AND:
The Grand Prize winning Drawing will be featured on a limited edition 2012 TD FEF reusable bag.

B. Nine Secondary Prizes:

(i) The winning Entrant receives:
(a) Twenty-Five Canadian Dollars (CDN$25); and,
(b) One (1) Litterless Lunchbox with an approximate retail value of Thirty-Five Canadian Dollars (CDN$35).
And
(iii) The winning Entrant’s School receives Five Hundred Canadian Dollars (CDN$500) to support environmental education or programs at the school.
AND:
The Secondary Prize winning Drawings may be featured on the 2012-2013 edition of Earth Day Canada’s EcoKids Calendar.

The combined value of all ten (10) Prizes available to be won is Thirteen Thousand Seven Hundred and Thirty-five Canadian Dollars (CDN$13,735). The odds of winning the Prizes are dependant on the number and quality of eligible Drawings received.

5. DECISION DATE:
All Drawings will be judged by a panel of judges, as the Sponsor, in its sole discretion may appoint. The panel of judges will determine the ten (10) winning Drawings, but in the event that the panel of judges does not, in the sole opinion of TD, produce one or more clear potential winners, the Sponsor reserves the right to select a winning Drawing. Selection of the ten (10) Drawings will be made in Toronto, Ontario at 10:00 a.m. ET on Friday, October 21, 2011 (the “Decision Date”).

The ten (10) Drawings which the panel of judges have determined most closely meet the selection criteria as set out above will be chosen to be uploaded onto a website at www.tdfef.com/artcontest to be the subject of a public vote to determine the one (1) Grand Prize winner and nine (9) Secondary Prize winners. From 9:00:00 a.m. ET on Monday, October 31, to 4:59:59 p.m. ET on Friday, November 11, 2011(“Voting Period”) the public will be able to vote on their favourite Drawing from among the ten (10) Drawings that have been uploaded. The Drawing that receives the highest number of votes will be declared the Grand Prize winning Drawing. In the event of a tie, the Sponsor shall, in its sole discretion decide the Grand Prize winning Drawing. The remaining nine (9) Drawings will be the Secondary Prize winning Drawings.

There is a limit of one (1) vote per Drawing per person/e-mail address/computer for the duration of the Voting Period portion of the Contest. If it is discovered that attempts were made to vote more than once per person/e-mail address/computer for the same Drawing, then only the first such vote will be valid and all other such votes associated with that IP address will be void. Use of any automated, script, macro or robotic program or use of different names per person/e-mail address/computer by the same person to submit per person/e-mail address/computer votes may result in the disqualification, in the sole discretion of the Sponsor, of the Drawing to which such votes relate. Also, systematic voting from the same computer/IP address over a short period of time may result in the disqualification, in the sole discretion of the Sponsor, of the votes and/or the Drawing to which such votes relate. Immediately after the Voting Period ends, the Drawing with the highest number of votes received will be deemed to be the Grand Prize winner. In the event that fan voting does not, in the sole opinion of the Sponsor, produce one or more clear potential winners, or is inconclusive due to technical difficulties, unreliability of the data, apparent voting irregularities, or any other cause whatsoever, the Sponsor reserves the right to select the winning Drawing.

6. PRIZE AWARDING: If your Drawing is selected as a potential winning Drawing, your Representative will be provided specific instructions on what is required in order to claim a Prize. Prizes will be awarded only upon verification and final approval by the Sponsor.

Attempts will be made to contact the Representatives at the telephone number, and/or mailing address provided at the time of entry, between 9:00 a.m. and 9:00 p.m. Eastern Time for a period of ten (10) working days following the Decision Date. All potential winners’ Representative will be required to complete, sign and return to the Sponsor, a Declaration and Release Form within seven (7) days from receipt. If any Representative fails to complete, sign and return the Declaration and Release Form to the Sponsor, that Drawing will be disqualified and another Drawing will be selected to win. By completing, signing and returning the Declaration and Release Form, the Representative (i) confirms compliance with these Contest Rules, (ii) releases and forever discharges the Sponsor, advertising and promotional agencies from all claims, demands, damages, actions and causes of action arising by reason of the acceptance or use of the Prize, (iii) gives permission to the Sponsor, at its option, to publish or otherwise use the winner’s first initial and last name, school, and Drawing, without compensation, in any publicity carried out by The Sponsor or its advertising agencies, and (iv) assigns all copyright in the Drawing to The Toronto-Dominion Bank and Earth Day Canada. Once being declared an official winner, after receipt of the signed and fully completed Declaration and Release Form, Representatives will be instructed on how to claim their Prize. Prizes must be accepted as awarded and no substitution, transfer, conversion or assignment of Prizes will be allowed, unless at the discretion of the Sponsor which may substitute a Prize of comparable or greater value. No correspondence will be entered into with Representatives except as described herein.

7. CONTEST GENERAL RULES: By entering the Contest, Representatives of Entrants agree to abide by these Contest Rules and the decisions of the Sponsor, which are final. The Sponsor shall in no way bear any liability whatsoever regarding any of the Prizes. The Sponsor will not be responsible for late, lost, invalid, illegible, delayed, incomplete, stolen, or misdirected Drawings/Prize claim documents. All Drawings/Prize claim documents become the property of the Sponsor, and will not be returned.

8. DISQUALIFICATION: The Sponsor is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other errors of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Contest, as determined by the Sponsor will be disqualified. In the event any portion of this Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of the Sponsor, which, in the sole opinion of the Sponsor, corrupts, or impairs the administration, security, fairness or proper Drawing into the Contest, the Sponsor reserves the right, at its sole discretion, subject to the Regie, to suspend or terminate this Contest or to amend the official Rules of the Contest.

9. QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping parties reach a settlement.

10. REST OF CANADA: For residents of all other Provinces/Territories outside Quebec, any litigation must be commenced in the City of Toronto, Ontario.

11. APPLICABLE LAWS: This Contest is subject to all applicable federal, provincial and municipal laws.

12. PRIVACY: By entering this Contest, you consent to the collection, use and sharing of information about you between the Sponsor and ED for the purpose of administering this Contest in accordance with the TD Privacy Code available at http://www.td.com/privacy/index.jsp.
